Appeals court rules against requiring Americans to buy healthcare insurance in Pres. Obama's healthcare law (917 hits)

An appeals court ruled Friday that President Barack Obama's healthcare law requiring Americans to buy healthcare insurance or face a penalty was unconstitutional, a blow to the White House.
WASHINGTON (Reuters) - President Barack Obama's healthcare law suffered a setback Friday when a U.S. appeals court ruled that it was unconstitutional to require all Americans to buy insurance or face a penalty.

The Appeals Court for the 11th Circuit, based in Atlanta, found that Congress exceeded its authority by requiring Americans to buy coverage, but also reversed a lower court decision that threw out the entire healthcare law.

The legality of the individual mandate, a cornerstone of the healthcare law, is widely expected to be decided by the U.S. Supreme Court. Opponents have argued that without the mandate, which goes into effect in 2014, the entire law falls.

The law, adopted by Congress in 2010 after a bruising battle, is expected to be a major political issue in the 2012 elections as Obama seeks another term in office and as all the major Republican presidential candidates have opposed it.

Obama has championed the individual mandate as a major accomplishment of his presidency and as a way to try to slow the soaring costs of healthcare while expanding coverage to the more than 30 million Americans without it.

The White House said it strongly disagreed with the ruling and voiced confidence the decision would not stand.

"Today's ruling is one of many decisions on the Affordable Care Act that we will see in the weeks and months ahead. In the end, we are confident the Act will ultimately be upheld as constitutional," Obama aide Stephanie Cutter said in a statement.

The Supreme Court is expected to take up the healthcare law during its upcoming term that begins in October with a ruling possible by the summer of 2012, just a few months before Obama faces re-election.

Twenty-six states had challenged the mandate, arguing that Congress had exceeded its authority by imposing such a requirement, but the Obama administration had argued it was legal under the Commerce Clause of the U.S. Constitution.

I would like one of the opponents of the individual mandate to explain why, when somebody exercises their right NOT to purchase health care, the rest of us who do purchase health care have to pay for their health care when they require it?

That sounds like health care welfare--sponging--to me.

It would be nice if we had a system of health like the UK so that all people can have access to care. I have to say that I'm not one for the Govt. mandating what citizens should or shouldn't have. If this, then what else? It should be left as an option.

Sister Irma,
America is great because we have freedom of choice as citizens. The matter of mandating that people buy insurance should be left up to the individual as an option just like buying any kind of insurance is an option. If someone gets sick and has to use the ER, they can't complain when the hospital ER staff does minimal things necessary to stablilize them and discharge them.

When I worked in the ER for the few months that I did, a doctor never turned down or declined care to a patient but the quality of the care is what was lacking. "Beggars can't be Choosey" You have heard of that saying, haven't you. SO for those people who don't buy insurance, don't COMPLAIN! Still I maintain the view that the decision to buy or not to buy insurance should be left up to the individual and not the Government.

One more thing... patients who overload the ER do so not just becuase they don't have doctors, but the ones who do come because their doctors tell them to go to the ER after hours instead of calling them and waking them up out of their sleep. There are many abuses going around on both sides of the table. Hospitals and doctors still send people bills whenever they receive treatment and if they don't pay... oh well ... that's another story. It's there choice...

I live in Canada so I do not know much about the American system so can someone please help me with this does everyone in the U.S that owns and drives a car!!, are they mandated to have auto insurance in order to drive that car on public road? Or is auto insurance an option for the individual who which to drive a car on public road thanks for the help

Your country is full of Govt mandated initiatives so trying to understand the freedoms that Americans have isn't something that most Canadians like yourself would bother to understand. In the event that I'm judging you Canadians wrongly, then I'd suggest that if you are truly interested rather than being sarcastic... go to the C-Span since you Canucks get plenty of American televisioning!

Sorry, but I had to deal with the "Canuck spy' among us who has a LONG lousy waiting lists for things (people wait for weeks and months for specialists and Govt services but they are so Polite that they don't complain under their fake democratic system there and he wants to know about car insurance that in Canada COSTS an ARM & A LEG --- PUHLEEZE! . ...

What I will end by saying to you dear sweet Irma is that this is a subject better left to agree to disagree. I'm sure you understand that we aren't seeing eye to eye on this matter.

Most Americans don't realize that the majority of Canadians aren't fond of Americans and that was the real reason for my response so if Soso isn't one of those type of Canucks then I do apologize. As far what I said about the long delays for Govt. services and the long waiting lists for specialists in Canada that is true. I read an article the other weekend about the LONG WAITING LISTS for OBESE patients waiting for Bariatric Surgeries. One woman wrote that she will die while waiting to get the needed weightloss surgery... thus some truth to the Palin Death Panels. In Canada, the citizens can't really do a darn thing about the long waits except keep quiet and be polite. What rubbish. I know that every country has its issues, but that is Ridiculous!

In Canada every Canadian has a medcair card, In differenf provence it’s called by a different name but nonetheless it’s the same I can go anywhere in Canada and get medical treatment, walk out the hospitol not bankrupt even if you’re on Govt asst, How is the system perfect no its not

My blog wasn't to down Canada's Health Care System, but Canadians make no bones about downing the American Health Care System when they want to justify their long wait lists. If Palin did get treatment in Canada, I think its her choice because I wouldn't. Soso Check Your Facts regarding Canadians coming across to AMERICA for Gastric Bypass Surgery.

FYI: I have a relative (she's a nurse, too) who lives in Ontario who has verified those wait lists for me. Her child needs speech therapy and she is on a LONG (9-10 MONTHS) WAITING LIST for the govt to pay for the therapy sessions. It's a good thing her child is 3 years old and not in school yet. That's the only way early intervention can work for her by getting her child on the list way early. How effective is that? AND she has a health card. If she wants to pay out of pocket privately and get the service straight away... its $110 per 45 minutes for private pay sessions.

You see my friend, you know that the waiting lists exists and for many like the Nova Scotian woman it is a DEATH PANEL. For the record, I have FACT checked as well as experienced the RUDENESS of Canucks towards Americans while visiting my relatives on several occasions and the funny thing about it, I thought Canucks were polite. Oh they were nice and polite as long as they didn't realize I was American. Ha!

Shona Holmes the brave and fed up Canadian woman who had a noncancerous brain cyst that was causing her to lose some of her vision? She spoke out about the waiting lists against your Federal Govt when so many Canucks are too, polite to do so. I remember reading about so many Canucks being upset that Shona spoke against their precious Canada in favor of American Health Care. Ha! The Canadian Health Care System (she had a health card, too) had her on a WAITING LIST because the cyst was classified as NONURGENT. It was urgent enough for Shona to come across the border to have the cyst removed! So much for your argument that the WAIT LISTS apply to Gastric - Weightloss. Hmmmmm..... Do you have anything else?

Neither am I knocking the American Health System, However one of the reason and I’m NOT trying to justify anything …………….There is a shortage across the board in the medical field in Canada the reason being most graduate has packed up and moved to the US because of $$$$$ even speech pathologist has packed it In and move and that’s a fact, thus the system is over loaded that has been a big complain in Canada however if you pay out of packet guarantee you will get help ASAP I am not trying to justify

As for the Nova Scotian woman / DEATH PANEL again I say (weight loss surgery) and I stress (weight loss surgery) if you said they need open heart surgery and it was prolong then no one can question your statement I must and I repeat must be very careful here in my statement Jen I agree with you Canadians are rude even to other Canadians I live in Montreal when I drive to Toronto Its only 500 miles I ask myself if I’m still in Canada

In Canada we have a Govt health system which is a single payer system as well private insurance I have booth

In the English speaking Provinces, people do wait for Open Heart Surgery especially if the hospital that has accepted them have no space. It happens my friend so before you discuss with me, please make sure you check your FACTS outside of your UTOPIA of Quebec.

Dearest and sweetest... I realize that you probably haven't a clue about the issues that Canucks have with our country so I will overlook your naive comments because its out of shear lack of experience with Canada. Once you visit there then come back and lets discuss. Those death panels exist, but you wouldn't know that unless you have people living there and WILLING to admit that there are LONG WAITING LISTS for things including waiting for Heart Surgery among the other things. People don't wait here in the States for such things.

Well let's see, hmmmm? I believe I've given you some pretty good FACTS thus far. Don't you think so? You know darn well that Canucks in French Speaking Canada are practically given a silver platter to eat off from Ottawa. Listen don't get me wrong, I'd love to visit or live in Montreal but first I have to dust off my French language skills so that I can really enjoy some of the entitlements/social programs that you enjoy up there.

If we want to be truly and I do mean truly honest about the Health Care system in the US, please be reminded that for 60 plus years the Govt has tried to implement a single payer system because the Insurance companies was hurting the citizen for profit and refusing to pay medical bills,

just when the individual needed them most, causing family’s to go bankrupt and broke or worst they claim pre-existing health issue thus the insurance company refuse to pay, I read of a case of a woman that was rape when she did seek psychological help her insurance claim it was pre-existing (may be someone out there can explain that one)


However President Obama, please note I live in Canada but he is my President too that’s my own selfish reason, but President Obama came into office can got done what every President before him had tried to do and FAILED, he got it done and for that the likes of Sarah Palin and others cried death panel,,, If we really want to be honest here you should ask the big question WHY?????

Now I must exercise caution here but if the WHY cannot be answered then there’s a Hugh problem, if the WHY can be answered then America should rise up and address the WHY for what it is, Again I AM exercising caution

But without the funds the mandate would have generated, experts question whether the $848 billion package of reforms could move forward. Without a mandate, Americans who choose to eschew health insurance will continue to do so — meaning the cost of implementing the law’s remaining provisions will skyrocket even more.

“This all but guarantees that the Supreme Court is going to have to hear this case, and very likely will hear this case next term,” said Robert Alt, a senior legal fellow and deputy director of the Center for Legal and Judicial Studies at The Heritage Foundation in Washington, D.C., adding that the Court will most likely give today’s decision the most weight. “I’m not aware of any time in our nation’s history when more than half the states have actively sued the United States over a law. And I think the Supreme Court is going to take this case very seriously.

“This is a real check, quite frankly, on what was a gross overstep by Congress.”....

Jen as a nurse I know part of your job discriptionis in a way playing god...if you see a patient who has formally requested that there be no attempt to save their lives, period, if you see them in a shape of dying say by chocking and you have been trained to get rid of the chocking threat plus the natural instict to help a drowing person or one about to be hit by a fast moving car you can not follow you instinct and does this make you a murder as in DEATH PANELS?????

It is much like those in your perfession can be held for breaking the law if you help in a traffic accident with first having permission to do so...you and your hospital play death panes when you can not treat a dying or near death child without permission...DEATH PANEL????? OR JUST NOT THINKING WITH AN OPEN MIND????????????????? 9NUP/ SMILE)

Jen, thanks for agreeing the that idea of a 'deat panel' is phoney and was made up to keep people brian dead on this was only to gurantee your request for your best interest as far as your medial treatment were made by you / your family...

and as far as Soso, Jen if you go back you will see taht you conventianly over looked Soso was ASKING A QUESTION ABOUT OUR SYSTEM...sand maybe you will be more able to understand how not accepting / overlooking FACTs the idea of 'deathpanels' ended up being the GOD'S truth when it was only to abusethose trying to force their medical insurance to work as they expected it to do when they paid into it. Jen do you remember what you said about you get the health care you pay for...I don't think this has anything to do with Palin's death panels...lets see if you are still Catholic then Palin's death panel has more to do with you than me a former Catholic...you see at my death bed I would want a Priest...Palin is saying no this can't be...it is grat to get different resources and do your own thinking because you may be getting rid of some of your own cherished rights be they moral or legal. (nup/ smile)

Oh and be careful of tose meds you had out to your patients because the next person sued for wrongful deaths could very well be you...watched any ads on meds on tv or do you know theone that are made in China????????????????? (nup)

@Jen, please don't take it personally, because I don't make laws in this country, I am only on the site to dialogue...and ironically if Brother Soso lives in the part of this country owned by England not long after our president's town Hall they are having the English Parmiment in sesson of these very things that our country is going through...as I said we need to use different resources and as I said if one wants to drive in Ca. you are required to have car insurence....

I would like to share with all something I learned on a talk radio program many years ago from an expertrelating to car insurance...a caller asked how much car insurance sould she have...the expert asked her if she owned her home and when she said yes, he said insure you car to cover your home just in case someone comes after your home because of hospital bills. (smile)

@Brother Soso, as I am one who believes we should use many different resources to get information...I suggest taht you go to C-span or whitehouse. org to recieve an open minded fully detailed answer by our president related to the Insurance Mandate question asked by a member in the live audance a few minutes ago at his Town Hall in Cannon Fall, Minnesota...this was one questionof many asked of our president and given full open minded answers to above and beyond the sound bites most of us just depend on. Jen lets try what I said all over again "K"?

No emergancy room CAN turn down a patient...I said nothing about paying for insurance or not paying for it...I have never been to an emergancy room and not being a PAYING person and my time there was not any quicker than the people already ther before I got there exceptone time when a ring had gotten stuck on my swollen finger and the nurse upon seeing it took me in and cut the ring off of my finger...I did not have to wait for a doctor nor any test.

If you are in the state of Ca. it is mandatory that you have car insurance...thekind if you get hurt and need medial care or you must pay for yours and everyone else's invloved in an accident wit your car be you the driver or not be it your faut or not...a little thing I cal equality when it comes topaying for insurance be it on your home you own or your apt you rent...iinsurance at least the way I look at it is one of the cheapest things you can buy because you can get sued for looking at osme one wrong...Because it all boils down to being able to pay what one owes not be told oh well you put your money in but...MY POINT IS LETS STOP THE PEOPLE OF WALL STREET SCREWING THE PEOPLE ON MAINSTREET... Jen this would be nice, but in the real world it is mandatory that emergancy rooms not turn down any patient which leads to hospitals having to go out of business because of this rule of they must pay their staff, for the equipments used, taxes, upkeep, ect. (smile)

example for the filthy rich and famous I am sure any hospital or doctor in private practice would never hesitate to have one of them as patients and for F-R-E-E if need be with a great big smile on ther face, but the poor will still have to pay more to cover the bill s made by the rich and famous, right? (smile)

Oh, anyone not know about the riots in the UK over disfied citizens on how their government falls short of what it is the average citizen needs, wants, ect. (nup)

Rich, with the rate that the cost of keeping hospitals open which seen so many of them now being forced to close their doors...this subject just may become mute...but as always mankind will find a way to return to nature where there is less danger from those meds now so deadly they put ads on tv warning about they will kill you, but buy them any way...too make a long story short on this matter...

this is going to have a back lash on those making tons of money off meds, because Rich notice how the voter's are demanding answers now not just the loudest most heard politician will get elected...

EDUCATE!!!EDUCATE!!!EDUCATE!!! IS SPREADING ALONG WITH VOTER'S REMORSE...This exact healthcare is only being denied to us what our politicians get with our tax monies, tha tis if one still has a job to even pay taxes from. (nup) .....CHANGE (smile)
